Terms of Service

By downloading, installing, or using the ListEka application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of a minor, you (the parent or guardian) agree to these Terms on the minor's behalf and are responsible for the minor's use of the Service.

ListEka is a smart shopping checklist application that allows users to create checklists, record item prices across different shops, and make informed purchasing decisions. The Service is provided by NSK Technologies ("we", "us", or "our").

• You must be at least 13 years old to create an account independently. Users under 13 may only use the Service under direct parental or guardian supervision.
• You must provide accurate and complete information when registering an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account at support@listeka.com.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Upload or transmit malicious code, viruses, or any other harmful software.
• Harass, abuse, or harm other users.
• Use the Service to collect or harvest personal data of other users without consent.
• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without our express written permission.

You retain ownership of the content you create within the Service (checklists, items, notes, etc.). By using the Service, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to provide the Service to you.

You are solely responsible for the content you create. We do not monitor user content but reserve the right to remove content that violates these Terms.

ListEka is a family-friendly application. If your child uses the Service:

• Parents and guardians are responsible for supervising their child's use of the Service.
• We do not knowingly collect personal information from children under 13 without verifiable parental consent, in compliance with COPPA.
• Parents may request the deletion of their child's account and associated data by contacting us at support@listeka.com.
• We do not display behavioural advertisements to any user.

The Service, including its design, logos, graphics, software, and all content created by us, is owned by NSK Technologies and protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited licence to use it.

"ListEka" and the ListEka logo are trademarks of NSK Technologies. You may not use them without our prior written consent.

The Service integrates with third-party services including Google (Firebase) and Apple for authentication and infrastructure. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.
• Update these Terms. We will notify you of material changes via in-app notification or email. Continued use after changes constitutes acceptance.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

TO THE FULLEST EXTENT PERMITTED BY LAW, NSK TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $50.

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where NSK Technologies is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

If you are located in the European Union, you may also have rights under EU consumer protection laws that cannot be waived by these Terms.

We may suspend or terminate your account at any time if you violate these Terms. You may delete your account at any time from the app settings. Upon termination, your right to use the Service ceases immediately and we will delete your data in accordance with our Privacy Policy.
